U.S. Senator Ted Cruz has sent a letter to Federal Energy Regulatory Commission Chairman Willie L. Phillips, urging an appeal against the U.S. Court of Appeals for the D.C. Circuit's decision to vacate permits for the Rio Grande and Texas liquified natural gas (LNG) projects.
In his letter, Cruz expressed concern about the potential impact of the court's decision on American energy infrastructure and national security. "The decision sets a chilling precedent that will harm the development of infrastructure for projects related to all forms of energy, directly undermining American energy security and therefore national security," he wrote. He added that if the permits are not reauthorized, over 7,000 high-paying jobs could be lost, along with roughly $24 billion in investments in the Rio Grande Valley.
Cruz highlighted America's position as the largest exporter of LNG since 2016, surpassing competitors such as Russia and Qatar. He noted that this achievement was made possible through private companies' work, innovation, and investment in capital-intensive projects. According to him, this progress is now at risk due to the court’s ruling.
He also referenced Charles McConnell, former Assistant Secretary of Energy under President Barack Obama’s Administration, who described the ruling as potentially "draconian" for investment progress if it stands.
Cruz pointed out further implications of the decision on other projects like the Brazos Island Harbor Channel Improvement Project—a $400 million initiative to deepen Brownsville's shipping channel—which might come to a halt if federal permits can be overturned due to procedural missteps by regulators.
"We look forward to your prompt response on this matter," Cruz concluded his letter.
