Governor Greg Abbott of Texas has further amended the disaster proclamation originally issued on April 30, 2024, and subsequently amended on May 2, May 7, and May 15 of the same year. The amendment comes in response to severe storms and flooding that began on April 26, 2024. These weather events included heavy rainfall, flash flooding, river flooding, large hail, and hazardous wind gusts that caused widespread property damage, injury or loss of life in multiple counties across the state.
The Governor stated: "WHEREAS, I, GREG ABBOTT...certifying that the severe storms and flooding...caused widespread and severe property damage, injury or loss of life in Anderson, Angelina...and Wilson Counties." He then proceeded to declare a disaster in additional counties including Calhoun, Delta, Jones, and Lamar.
In accordance with Section 418.014 of the Texas Government Code, Governor Abbott authorized the use of all available resources of state government and political subdivisions to manage this disaster. He also invoked Section 418.017 of the code to suspend any regulatory statute or rule that could prevent or delay necessary action in coping with this disaster.
He stated: "Pursuant to Section 418.016 of the Texas Government Code...any order or rule of a state agency that would in any way prevent...necessary action in coping with this disaster shall be suspended upon written approval of the Office of the Governor."
Moreover, Governor Abbott granted permission for any state agency's emergency response to override statutes or rules regarding contracting or procurement if such enforcement would impede actions necessary to protect life or property threatened by this declared disaster.
The Governor signed off his statement by saying: "IN TESTIMONY WHEREOF, I have hereunto signed my name and have officially caused the Seal of State to be affixed at my office in the City of Austin, Texas..."
The proclamation was attested by Jane Nelson, Secretary of State.
