U.S. Sen. Ted Cruz of Texas, a prominent figure on the Senate Judiciary Committee, has taken a legal step concerning an immigration program established during President Obama's tenure. Cruz filed an amicus brief related to the case Save Jobs USA v. Department of Homeland Security. The brief aims to support a Petition for a Writ of Certiorari, urging the Supreme Court to review a policy that permitted certain foreign nationals' spouses to obtain work permits in the United States.

Sen. Cruz's action reflects his belief that this program, which continued under both the Obama and Biden administrations, oversteps Congress's authority. According to Sen. Cruz, "For far too long, career agency bureaucrats have sought to bypass Congress’s authority to prescribe laws regarding visas. We hope the Supreme Court will grant review in this case, end immigration visa abuse, and clarify the legal process to obtain lawful immigration status in the United States."

Joining Cruz in this legal endeavor are Senators Marsha Blackburn from Tennessee, Eric Schmitt from Missouri, Jim Banks from Indiana, Ted Budd from North Carolina, and Mike Lee from Utah. This collective effort highlights a shared perspective among these lawmakers on the matter.

Previously, in 2023, Sen. Cruz was involved in another similar legal matter. He filed an amicus brief requesting the Supreme Court to examine the case of Washington Alliance of Technology Workers v. Department of Homeland Security.
