The brief argues that the Colorado Supreme Court's decision to remove Trump from the ballot infringes upon the prerogatives of members of Congress and undermines the democratic process.
In the case of Trump v. Anderson, the U.S. Supreme Court is considering whether Trump should remain on the ballot in Colorado, despite the state's Supreme Court ruling against him. The legislators contend that the Colorado Supreme Court's opinion disregards the constitutional separation of powers and expands the definition of "engage in insurrection," which could lead to abuse against political opponents. They urge the U.S. Supreme Court to reverse the Colorado Supreme Court's decision.
Senator Cruz expressed his confidence that the Supreme Court will see through the efforts to undermine democracy by banning Trump from the ballot. He stated, "The American people see through this, and I’m confident the Supreme Court will as well. I’m proud to work with Leader Scalise and our fellow legislators to defend the Constitution’s separation of powers, and the ability of the American people to decide who their next president will be."
Leader Scalise criticized President Biden and his allies for claiming to defend democracy while attempting to undermine the people's power to choose their leaders. He argued that the Colorado Supreme Court has no authority to remove Trump from the ballot and that their decision sets a dangerous precedent. Scalise emphasized the importance of standing up for American voters and the Constitution, urging the Supreme Court to carefully consider their arguments and reverse the decision.

Hamilton emphasized the need to support President Trump's case before the Supreme Court and called for the decision to be overturned.
