A new bill authored by State Rep. James Talarico in the Texas House seeks to regulate possession, manufacture, and transfer of certain weapons and related devices under state law, according to the Texas Legislature website.
The bill on Courts and State Agencies, Boards & Commissions category, introduced as HB 259 during the 89(2) legislative session on Tuesday, Aug. 19, was formally listed with the short title: ’Relating to the Independent Citizen Redistricting Commission and the redistricting of the districts used to elect members of the United States House of Representatives, the Texas Legislature, and the State Board of Education’.
The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.
In essence, this bill amends the Texas Penal Code to prohibit the possession, manufacture, transportation, repair, or sale of certain items unless they are registered under the National Firearms Registration and Transfer Record or classified as curios or relics. These items include explosive weapons, machine guns, armor-piercing ammunition, chemical dispensing devices, zip guns, tire deflation devices, and improvised explosive devices. The bill specifies defenses for dealing with tire deflation devices or armor-piercing ammunition if used solely as antiques or for certain organizations. Additionally, it repeals Section 46.01(10) of the Penal Code. The changes apply to offenses committed on or after the act’s effective date, Sept. 1, 2025, maintaining the previous law for prior offenses.
James Talarico, the vice chair of the House Committee on S/C on Academic & Career-Oriented Education and the vice chair of the House Committee on Trade, Workforce & Economic Development, proposed no other bills during the 89(2) legislative session. He is also a member of the House Committee on House Administration and a member of the House Committee on Public Education.
Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
