This bill amends Article 17.291(b) of the Texas Code of Criminal Procedure to extend the detention period for individuals arrested for crimes involving family violence. After posting bond, such individuals may be held for four hours if there is probable cause to believe that releasing them would lead to continued violence. This period can be further extended, not exceeding 48 hours, if a magistrate issues written authorization. The magistrate must conclude that releasing the individual would result in continued violence and, if extending beyond 24 hours, that within the past 10 years, the person has prior arrests for family violence or offenses involving a deadly weapon. The bill takes effect Sept. 1, 2025.
