Lawmakers reintroduce bill mandating disclosures on smart device recording capabilities

U.S. Senators Ted Cruz, Maria Cantwell, and John Curtis have reintroduced the Informing Consumers About Smart Devices Act. This bipartisan bill mandates that the Federal Trade Commission (FTC) establish disclosure guidelines for household products equipped with audio or visual recording components that are not immediately apparent to consumers. The aim is to inform consumers about potential privacy invasions by appliances such as refrigerators, washers, dryers, and dishwashers that may come with cameras and microphones.

Senator Cruz highlighted the widespread use of internet-connected smart devices in homes across the nation. He noted, “Many Americans aren’t made aware that many of these devices and appliances are being built with cameras and microphones that can surreptitiously record families and transmit data.” Cruz emphasized the need for clear communication from manufacturers regarding these capabilities.

Senator Cantwell pointed out projections indicating over 84 million households will have smart devices by 2026. She stated, “Most consumers expect their refrigerators to keep the milk cold, not come equipped with a camera or microphone to record their personal and private family discussions.”

Senator Curtis underscored consumer rights in his remarks: “Consumers have a right to know when their household devices include equipment that can record or transmit data.” He stressed transparency as technology advances.

The legislation was initially introduced during the 118th Congress by Senators Cruz and Cantwell in the Senate and Senator Curtis alongside Representative Seth Moulton in the House of Representatives. It has previously been reported favorably by the Senate Commerce Committee.
