Governor Greg Abbott of Texas has vetoed Senate Bill 3, citing significant constitutional concerns and potential legal challenges. The bill aimed to regulate hemp products in the state but faced opposition due to fears it could criminalize products that federal law permits.

“Texans on each side of the Senate Bill 3 debate raise serious concerns,” Governor Abbott stated. He emphasized the need for immediate regulation of hemp for public safety but argued that the current bill would face substantial legal hurdles. “If I were to allow Senate Bill 3 to become law, its enforcement would be enjoined for years, leaving existing abuses unaddressed.”

The governor drew parallels with a similar situation in Arkansas, where a comparable law was halted by federal courts due to conflicts with federal statutes. Abbott expressed concern that Texas could face similar outcomes, rendering the bill ineffective while legal proceedings continue.

Abbott criticized the bill’s approach, which would prohibit manufacturing or possessing consumable hemp products containing cannabinoids other than CBD or CBG. This stipulation clashes with federal regulations that permit such products if they meet THC thresholds set by Congress.

Highlighting potential consequences for various stakeholders, Abbott noted, “Senate Bill 3 not only invites potential criminal entrapment for Texas farmers. It would also make felons of other innocent Texans.” He underscored how this could impact pharmacists and parents using FDA-approved medications.

In light of these issues, Governor Abbott announced plans for a Special Legislative Session in July to devise a more legally sound regulatory framework. “Texas must enact a regulatory framework that protects public safety, aligns with federal law,” he said.

The proposed alternatives include regulating hemp similarly to alcohol through agencies like the Texas Alcoholic Beverage Commission and implementing strict penalties for non-compliance. Suggestions range from prohibiting sales near schools and requiring child-resistant packaging to limiting THC content in products.

Abbott concluded by emphasizing the importance of creating enforceable laws that enhance community safety promptly rather than deferring solutions indefinitely due to legal disputes.

“Passing a law is not the same thing as actually solving a problem,” he remarked. The upcoming legislative session will provide an opportunity for lawmakers to address these critical issues effectively.

Abbott signed off on his decision on June 22, 2025, ensuring his objections were filed with the secretary of state according to constitutional requirements.
